Aelith Pay Acceptable Use Policy

This policy explains what merchants may and may not use Aelith Pay for. It applies to hosted checkout, payment links, invoices, API usage, and direct-settlement merchant accounts.

1. Overview

Aelith Pay provides software and checkout infrastructure. Merchants are responsible for the products and services they sell, the truthfulness of their marketing, required licenses, customer disclosures, and compliance with the laws that apply where they operate and where their customers are located.

2. Permitted Use

Merchants may use Aelith Pay for lawful products and services, including merchants that face elevated reserve pressure, settlement delays, or dispute exposure in conventional card-payment systems, including licensed crop-protection, specialty chemical, and similar regulated businesses, so long as the merchant activity complies with this policy, our Terms of Service, and applicable law.

3. Prohibited Activity

  • Controlled substances or scheduled drugs that are unlawful to possess, distribute, import, export, or sell in the relevant jurisdiction.
  • Prescription pharmaceuticals or medical products sold without all required licenses, authorizations, or legal authority.
  • Fraud, deceptive business practices, impersonation, stolen goods, account takeover services, card data trafficking, or counterfeit goods.
  • Malware, ransomware, botnets, credential theft, unauthorized access tools, or paid hacking services.
  • Child sexual abuse material, human trafficking, forced labor, terrorist financing, or any form of violent criminal enterprise.
  • Sanctions evasion or transactions involving prohibited parties, prohibited territories, or blocked persons where a legal authorization is required and absent.
  • Products, services, or marketing claims that are illegal in the merchant or customer jurisdiction, even if the merchant labels the offer as research-only or not for human use.

4. Merchant Responsibilities

  • Maintain all licenses, registrations, permits, and age-gating controls required for the products or services sold.
  • Provide accurate product descriptions, fulfillment terms, refund policies, and customer support information.
  • Avoid shipping or selling into jurisdictions where the relevant product or service is prohibited.
  • Use Aelith Pay only for the business activity disclosed to Aelith and update that disclosure if the business model changes materially.
  • Handle refunds, returns, and customer service directly, recognizing that confirmed onchain transactions may be irreversible.

5. Compliance and Screening

Aelith Pay may apply sanctions screening, risk scoring, merchant-profile review, API monitoring, rate limiting, and manual investigation to reduce legal, fraud, and abuse risk. These controls are part of the service and are not optional for merchants.

6. Enforcement

If Aelith reasonably believes a merchant has violated this policy, Aelith may suspend or terminate checkout access, API access, merchant accounts, or payment flows. Because settlement is designed to go directly to merchant-controlled wallets, enforcement generally means disabling access to Aelith services rather than freezing merchant wallet balances.

7. Legal Requests

Aelith Pay may preserve or disclose relevant records when required by valid legal process or when necessary to investigate fraud, sanctions risk, platform abuse, or threats to users, customers, or the public.

8. Questions and Disclosures

Merchants with specialized products, regulated goods, or unusual jurisdictional exposure, including crop-protection or specialty chemical products, should contact support@aelith.ai before going live. Clear disclosure up front reduces onboarding friction and avoids preventable service interruptions later.
